The Decision of The Constitutional Court dated February 1, 2024 with file no 2022/154 and decision no 2024/33 was published in the Official Gazette numbered 32489 on March 14, 2024.

The purpose of this Decision is to protect the right to rest guaranteed by the Constitution.

Paragraph 7 of Article 40 of the Maritime Labour Law ("Law") states that "If the service contract is terminated in accordance with paragraphs II, III and IV of Article 14 before the seaman has used the annual paid leave to which he is entitled, the employer or the employer's representative must pay the seaman the wage for the leave period." Subparagraph I of Article 14 of the Law, which is not mentioned in the relevant article, regulates the employer's right of termination in cases where it becomes impossible for the seaman to work and there is a contrary to the law, customs and ethical rules.

With the amendment made on January 25, 2024, temporary Article 101 was added to the Social Insurance and General Health Insurance Law No. 5510 (In Turkish), and the application of minimum wage support was continued.

The mentioned article provides that employers who employ insured persons subject to long-term insurance branches under clause 4/1-a can benefit from minimum wage support, and general regulations regarding the conditions for benefiting from the support, and in which cases the support will not be provided have been introduced. In summary;

Law Amending the Unemployment Insurance Law and Certain Laws was published in the Official Gazette numbered 32449 on February 3, 2024.

The purpose of the Law is to make arrangements for short-time working allowance in general.

The related Law entered into force by amending the additional article 2 of the Unemployment Insurance Law dated August 25, 1999 and numbered 4447 ("Unemployment Insurance Law").

The 2024 minimum wage support has come into force with the Law No: 7417 published on the Official Gazette dated 03 February 2024 and numbered 32449.

Based on that, in case that all conditions are met, the minimum wage support will be automatically deducted from the social security premium payments on the upcoming periods by the Social Security Institution without any application.
