Compulsory and Arbitrary Mediation in Labor Law

Mediation, one of the alternative dispute resolutions methods, is regulated by Mediation in Legal Disputes Law No. 6325 (In Turkish.), and a legal basis has been prepared for legal disputes. Mediation is the method used by the parties for a private law dispute before or after filing a lawsuit under the arbitration of an impartial third party (mediator) who has received specialized training, chosen by their own free will.

There are two types of meditation in Turkish Law; "compulsory mediation" and "arbitrary mediation."

2022 1st Period - Severance Ceiling Amount

According to the 27998389 - 010.06.02-854887 numbered Circular published by the Ministry of Treasury and Finance with the subject ‘Financial and Social Rights’, the coefficients used to calculate the wage of public officers have been revised effective 01.01.2022.

Income Tax Exempted Severance Payment

The following value has been calculated taking these coefficients into account and shall be applied for the period between the dates of 01.01.2022 – 30.06.2022 maximum severance payment to be exempted from income tax is determined as 10,596.74 TRY.

COVID-19 Measures in Workplaces

The Ministry of Labor and Social Security has sent an opinion letter numbered 38611 and dated 17.09.2021 to The Union of Chambers and Commodity Exchanges of Türkiye regarding the COVID-19 measures that can be taken in workplaces.

In this opinion letter, the below points have been stated:

  1. Workplaces/employers would need to inform employees about the health and safety measures in workplaces.
  2. Employers would need to inform the employees in written form for those who have not completed their COVID-19 vaccination.
  3. Employers would need to inform the employees, who do not complete the vaccination, about the results that would be taken in the workplace based on the Labor Law and Social Security Legislation.

  • For Antalya, Mersin, and Osmaniye provinces, between 28.07.2021 - 26.08.2021 (included)
  • For Adana and Muğla provinces, between 29.07.2021 - 26.08.2021 (included)
